Both Sides of His Mouth

Supreme Court Justice Stephen Breyer would like to have it both ways in defending Justice Anthony Kennedy for referring an opinion to international law concerning the death penalty for juveniles. "It's appropriate in some instances" to look at what goes on in other countries, Jutice Breyer said. "They do not bind us by any means." Then why bother to look outside of our Constitution? The job of any judge is to follow the rule of law, the law of the United States, not an international body. Justice Breyer can't legitimately side step the question by suggesting he may look at international law providing he doesn't use it in an opinion. Simply by suggesting this implies usage. He should know it's an appearance of impropriety that may suggest a wrongdoing.
