Conservative activists forced Miers to withdraw from consideration for this same Supreme Court seat because she was not radical enough for them. Now the Senate needs to find out if the man replacing Miers is too radical for the American people.

Lewis "Scooter" Libby is not charged with knowingly disclosing Ms. Valerie Plame's CIA affiliation in order to disclose the identity of a secret agent. At the end of the two-year investigative process the special prosecutor announced that he couldn’t produce evidence that the conduct he has investigated constituted a crime. xxx Ted Olson, former Solicitor General states, "Mr. Fitzgerald (Special Prosecutor) justified his subpoenas on the ground that the journalists were "eyewitnesses to the crime." But he was unable to establish, and he certainly hasn't charged, that there was a crime in the first place." xxx So what we have is open season on politically motivated character assassination by the likes of Senator’s Reid and Dodd on the Sunday talk show circus. Stay tuned; this is all the Dem's have.

Fox's Rick Folbaum Misrepresents, You Decide

Rick Folbaum stated that I. Lewis "Scooter" Libby was indicted, in part, on a charge of "cover up." I read the indictment and the charges as displayed at FoxNews.com and the Wall Street Journal including the PDF copy of the actual document.

No where do the words "Cover Up" come into play. For a media outlet who uses the phrase "Fair and Balanced" as its credo, the Fox News groups continue to come off as sensualists, incriminating and falsely accusing people of crimes they haven't committed or even alleged to have committed.

Oil for Whom? Cash Payoffs for Everyone!

The Volcker report confirms that Saddam Hussein demanded, and got, some $1.8 billion in illegal surcharges, kickbacks and bribes from companies doing business in Iraq.

Under Oil for Food, Iraq sold $64.2 billion in oil and purchased $34.5 billion in humanitarian goods. Of the oil purchasers, the Volcker report finds that 139 out of 248 companies paid illicit oil surcharges, which ranged from 10 to 50 cents a barrel. Among the 3,614 companies that provided humanitarian goods, 2,253 -- that's two thousand two hundred fifty-three -- companies paid some kind of kickback, or "after-sales service."

This "gentleman" led a delegation of anti-war Congressional Democrats to Baghdad in September 2002 and who funded an anti-sanctions documentary produced by former weapons inspector Scott Ritter. (Where is Mr. Ritter these day?)

Many companies involved were small, probably serving as fronts. Here are some prominent names:

  • Construction equipment division of Sweden's Volvo - $535,000 in kickbacks
  • Germany's Siemens - $1.6 million in kickbacks
  • Daewoo
  • Australian food exporter AWB
  • Scottish engineering firm Weir

Last but not least is the French bank, BNP-Paribas, assigned to manage the oil-for-food funds. who earned a tidy $173 million in fees. Mr. Volcker states "BNP itself became an instrument for the payment of millions of dollars in illegal surcharges while doing little to detect or prevent such payments." Nice work if you can get it.

In total, this is a $100 Billion scandal! The full list of people and companies who received illegal payoffs is 60 pages. The full report is so big it could be used as a door stop, hopefully, as people pass through on their way to jail!

Bush Reinstates Davis-Bacon Act

"Worker-friendly" legislation that requires federally funded construction projects to pay the "prevailing" wage rate in a given area. xxx In reality the anti-competitive 1931 law is a relic of the Jim Crow era. New York Congressman Robert Bacon was upset about an Alabama contractor who had brought a largely black construction crew to build a federal hospital in his district.
xxx "Colored labor is being brought in to demoralize wage rates," complained the American Federation of Labor at the time. Many economists and minority leaders recognize that Davis-Bacon continues to be a cause of minority unemployment in the construction sector to this day. In addition to that ugly history, Davis-Bacon is known for creating mountains of paperwork and unnecessary compliance costs. xx As a free-market conservative I must express more concern about policies coming from the Bush administration. Re-instating a law after reversing it offers a look at politics vs. economic common sense. The more we "read the Presidents lips" the more we see the conservative wheels coming off. A law established during the FDR years is tainted by big union, anti-business policy. It will increase construction costs in hurricane-devastated areas and pander to unions much like the tariffs imposed on steel in Bush's first term.

Harriet Miers withdrew her nomination to be a Supreme Court justice Thursday in the face of stiff opposition and mounting criticism about her qualifications. President Bush is claiming this is because of Senate calls for the release of internal White House documents that the administration has insisted were protected by executive privilege.

Responding to a request from a Muslim group to recognize one of their holidays, the Tampa area Hillsborough County School Board instead took away holidays for Yom Kippur, Good Friday, and other religious holidays that haven't become totally secularized.

Hillsborough County School Board approved a 2006-07 calendar minus holidays for Yom Kippur, Good Friday or the Muslim holiday Eid Al-Fitr. The 6-1 vote represents a major shift from scheduling days off on religious holidays, a practice School Board Attorney Tom Gonzalez on Tuesday said was wrong. "A school board cannot recognize a religious holiday for the sole purpose of recognizing a religious holiday," Gonzalez said at a meeting packed with dozens of members of the Muslim community, some pleading to have no school on holidays for all religions.

Only board member Jennifer Faliero voted against the new calendar, saying she checked with other lawyers and believes Good Friday is a secular holiday: "It is now about the Easter Bunny. ... They have taken religion out of it completely."

One Axis of Evil Speaks!

Iran's hard-line president called for Israel to be "wiped off the map" and said a new wave of Palestinian attacks will destroy the Jewish state. Mahmoud Ahmadinejad also denounced attempts to recognize Israel or normalize relations with it.
xxx "There is no doubt that the new wave of attacks in Palestine will wipe off this stigma (Israel) from the face of the Islamic world," Ahmadinejad told students Wednesday during a Tehran conference called "The World without Zionism."
"Anybody who recognizes Israel will burn in the fire of the Islamic nation's fury, any (Islamic leader) who recognizes the Zionist regime means he is acknowledging the surrender and defeat of the Islamic world," Ahmadinejad said.

N.Y. Times Eats Its Own!

New York Times reporter Judith Miller has begun discussing her future employment options with the newspaper, including the possibility of a severance package.

Both the editor and the publisher of the Times have expressed regret for their unequivocal support for Ms. Miller when she spent 85 days in jail for refusing to testify before a federal grand jury investigating the unmasking of a Central Intelligence Agency operative.

The Times feels Ms. Miller misled them in her reporting of weapons of mass distruction which bolstered the Bush Administration case to go to war in Iraq. Miller failed to disclose a meeting or certain contact she had with Vice-President Cheney chief of staff, I. Lewis "Scooter" Libby. The Times felt slighted.

Seems the Times has trouble substantiating what there reporters write and the accuracy of their stories as with Jason Blair. Over the weekend, two columnists for the Times wrote pieces questioning whether Ms. Miller could continue working for the paper.

George W. Bush... Failed Conservative Agenda

Conservatives fall into one or more areas as follows:
  • Religious/Social Conservatives
  • Economic Conservatives
  • Economic Libertarians

President Bush, by example, falls in the Religious/Social Conservative camp as a "True Believer." As a CPA holding an MBA from Northwestern University I am a free market, economic conservative. I studied Milton Friedman's "Monetarist" economics as well as "Supply-Side" economics and believe in tax cuts, small government with the function of running a lean fiscal machine.

I personally agree that Roe v. Wade should, in fact, be overturned. Under the Constitution and strict Federalism this ruling does not follow anything concerning "Right to Privacy" that can be found anywhere in Constitutional law.

With the nomination of Harriet Miers for Supreme Court, Bush has failed to present an individual with proven social conservative values or the legal intellect which we presume is an important qualification to sit on the highest court in the land. Nothing in Miers legal history demonstrates a Federalist/Constructionist legal stance.

Republicans in congress have spent and spent along with Democrats at a record pace and have failed thus far to make the Bush tax cuts permanent. Capital gains taxing, dividend taxing and especially the "death tax" on estates should be eliminated to ensure some integrity to economics and aid in fixing a broken tax system. Bush and Republicans in congress have failed to vigorously promote a true conservative fiscal agenda.

Tax cuts have helped avoid inflation growth and reduced the deficit at a faster then predicted pace despite the spending orgy by all of congress. If Bush would have vetoed pork filled energy and transportation bills government would be held accountable to reduce it's size as well as the national debt.

President Bush has allowed himself to become side-tracked all but eliminating any chance of Social Security reform. In addition, he didn't have full support of congressional Republicans. Bush has failed to prove his case, which should be a complete revamping of a welfare system produced by "progressives" and FDR. A reduced government would allow individuals to manage their earned income and not leave it to the irresponsible politicians residing over continued big government. This should be an easy sell but George Bush simply isn't eloquent enough to present his case and has now allowed the whole issue to fall off the radar screen.

Illegal border immigration should be stopped and the Bush administration has consistently ignored this problem hoping it would go away or be forgotten. Paying for education and medical care for aliens who cross our borders is condoning welfare and furthering hindering education reform in this country. Bush allowed Ted Kennedy to write the original education reform bill, had a nice ceremony in the Rose Garden but failed to adequately hold schools accountable. Our borders are still porous as we waste dollars with inadequate methods to ensure against illegal immigration.

Bush has spent his "political captital" by wasting it with the Miers nomination, lack of initiative on Social Security, failure to fight for permanent tax cuts and poor immigration and border control. With possible indictments of Rove and Libby the Bush administration is tending to an open chest wound with a band-aid.

Bush and his administration have three years to take a complete social and economic conservative initiative or continue to empower liberals and allow another Clinton administration. We can do better and it's time the "Cowboy from Texas" takes a conservative policy before he rides into the Texas sunset leaving us with liberals in charge.

Israel and Bush Cave In to Terrorists!

Israel has dropped its campaign to ban the violent Islamic Hamas from Palestinian parliamentary elections.

When Palestinian leader Mahmoud Abbas met with Bush at the White House. Bush warned Abbas that violent Palestinian groups could undermine the democratic Palestinian state-in-the-making but failed to mention Hamas by name nor call for its exclusion from the election, a sign that despite Israel's strong feelings, the U.S. was not going to press the point.

When Abbas was in Washington, Palestinian gunmen killed three Israelis in a drive-by shooting in the West Bank and the Al Aqsa Martyrs' Brigades, linked to Abbas' Fatah, claimed responsibility.

As I carefully watch the actions of the Bush administration I really wonder how many wheels are on the car and how many pistions are firing in the engine. What happened to "you're either with us or against us" in the fight against terrrorism and not negotiating with terrorists.

Palestinian Leader Crying Foul

Mahmoud Abbas is visiting President Bush at the White House today, something his predecessor was not allowed in the current administration. Unfortunately Abbas is playing the "victim" as he is quoted in today's Wall Street Journal.

Abbas seems to think Hamas and Palestinian terror towards Israel is an illusion and the Gaza strip was left to his people by their hand and not the forward thinking of Ariel Sharon. Palestinians claimed victory when Israel handed Gaza over after dismantling its settlement with a showdown against fellow Jews. Abbas complains about continued closed borders but fails to mention continued threats against Israel by Hamas, fails to mention the conflict between Palestinian police and Hamas and near civil war conditions within his borders.

Abbas asks for help from the international community, the U.N. and others who are anti-semitic and blame Israel for Palestinian problems and not their former terrorist regime, suidcide bombers and as usual, Hamas who calls for the complete destruction of Israel.

He just answered part of his question on Israeli cooperation. Abbas complains of unilateral action by Israel in one sentence and then moans that Israel refuses to follow the "Roadmap to Peace." The fact is Israel has been alone in the peace process for years, presided over by two U.S. administrations and no peaceful cooperation by Palestinian leadership who signed agreements then looked towards violence against Jews.

If the Palestinians want to conduct themselves peacefully they must have Hamas turn in their weapons and desolve as an organization. The peace problem is for Palestine to recognize the Bush administration does not negotiate with terrorist like Carter and Clinton nor should Israel be required to do so. Abbas uses the word "fundamental" frequently, he should face the fact that terrorist groups are never a part of honest participation in any fundamental road to peace.

Been sitting here with my ass in a wad, wanting to speak out about the bullshit going on in New Orleans. For the people of New Orleans... First we would like to say, Sorry for your loss. With that said, Let's go through a few hurricane rules:

#1. A mandatory evacuation means just that...Get the hell out. Don't blame the Government after they tell you to go. If they hadn't saidanything, I can see the argument. They said get out... if you didn't, it's your fault,not theirs. (We don't want to hear it, even if you don't have a car, you can get out.)

#2. If there is an emergency, stock up on water and non-perishables. If you didn't do this, it's not the Government's fault you're starving.

#2a. If you run out of food and water, find a store that has some.(Remember, shoes, TV's, DVD's and CD's are not edible. Leave them alone.)

#2b. If the local store has been looted of food or water, leave your neighbor's TV and stereo alone. (See #2a) They worked hard to get their stuff. Just because they were smart enough to leave during a mandatory evacuation, doesn't give you the right to take their stuff...it's theirs, not yours.

#3. If someone comes in to help you, don't shoot at them and then complain no one is helping you. I'm not getting shot to help save some dumb ass who didn't leave when told to do so.

#4. If you are in your house that is completely under water, your belongings are probably too far gone for anyone to want them. If someone does want them, let them have them and hopefully they'll die in the filth. Just leave! (It's New Orleans, find a voodoo warrior and put a curse on them.)

#5. My tax money should not pay to rebuild a 2 million dollar house, a sports stadium or a floating casino. Also, my tax money shouldn't go to rebuild a city that is under sea level. You wouldn't build your house on quicksand would you? You want to live below sea-level, do your country some good and join the Navy.

Norwegian Teen Receives Award then Indictment

At the age of 15, Norwegian, high school dropout, Jon Lech Johansen wrote a computer program that allowed users to copy DVDs. Then he posted it on the Internet. A Norwegian private school awarded him a prize for making an outstanding contribution to society. The Norwegian government indicted him.

Young Mr. Johansen was tried twice and acquitted twice. Johansen simply wrote the software and posted it, nothing illegal about that. However, using the software to download copywrited material is illegal.

Bluetooth Boobs!

Computer chips that store music could soon be built into a woman's breast implants. One boob could hold an MP3 player and the other the person's whole music collection.
BT futurology, who have developed the idea, say it could be available within 15 years. BT Laboratories' analyst Ian Pearson said flexible plastic electronics would sit inside the breast. A signal would be relayed to headphones, while the device would be controlled by Bluetooth using a panel on the wrist.
Pearson said: "It is now very hard for me to think of breast implants as just decorative. If a woman has something implanted permanently, it might as well do something useful."
The sensors around the body linked through the electrical impulses in the chips may also be able to warn wearers about heart murmurs, blood pressure increases, diabetes and breast cancer.

The statistics reflect the relative calm in the territories vis-a-vis Israel as well as the increasing anarchy in PA-controlled areas.

Opinion Journal and Drudge provide testimony in Williams v. Dallas, a voting-rights case from 1989, when Miers was an at-large member of the Dallas City Council. Here is an interesting section:

John Fund at Opinion Journal provides an interesting view, and some qualified opinions on How She Slipped Through in reference to the "vetting" process of Harriet Miers for Supreme Court.

"In business you make an effort to have disinterested directors who know all the material facts to resolve conflicts of interest. In the Miers pick, the White House was sowing its own minefield."

As with then First Lady Hillary Clinton, we don't particularly like the fact that First Lady Bush "weighed in" on this critically important nomination. Although we do like and respect Mrs. Bush, she is not an elected official and doesn't have any valid information or qualifications that would aid in the vetting process. It's unfortunate President Bush seems to have looked at tea leaves instead of having a conscientious and thorough process for such an important matter as filling a Supreme Court seat.

Ms. Whitman & eBay Leave Us "Stunned"

In an investigation that started last year, New York Attorney General Elliot Spitzer's office found that eBay users were easily able to buy stun guns through the company's Web site. Investigators, posing as customers, bought 16 stun guns from 16 different sellers on eBay.
xxx The sellers, 14 of whom are from outside New York, are believed to have sold more than 1,100 stun guns to New Yorkers from September 2003 to August 2005, investigators said. Included in the sales were a Taser stun gun valued at $57 and a $400 "Air Taser" that delivers a 50,000-volt disabling shock.

It's nice to know this took two years but eBay recently took down a Britney Spears auction for selling "used" under garments for donation purposes. Spears broke the eBay rule for used underwear and the auction was reinstated under a different category.

It's also been my personal experience that eBay will suspend your account if you get caught denouncing Ms. Whitman and her cohorts on eBay message boards. Of course they deny this but it happened and the only correlation was speaking out against eBay greed at the expense of sellers.

We're all for gun rights but stun guns are extremely dangerous and don't quite fall in the category of "guns." Charlton Heston may disagree. Will eBay allow these sales to continue in other states or internationally? Will Big Brother at eBay wake up? Stay tuned.

For Liberals, Abortion & Minors Right to Privacy Trumps Parenthood

Left-Wing zealots like Senator Barbara Boxer (D-CA) are currently crying out against initiatives of California Governor, Arnold Schwarzenegger, to have parents or guardians notified when a minor in their care is about to have an abortion.

As with activist family court judges, politicians want laws to limit the rights of parents to monitor their childs activities. This is one more demonstration by the left of anti-traditional family values. It's ok to have two male or two female parents under one roof, remove Dad from the household (a favorite of Liberals everywhere) and allow junior to run wild with free sex, free condoms, free needles and so on.

While the left makes fun of conservative moral values, the simply fact is politicians like Boxer are more afraid of having Roe v. U.N. Looking to Assert Control Over Internet

The Internet was developed in the U.S., including upgrades like Internet 2, and is not a collective global resource. It is an evolving technology, largely privately owned and operated.

The European Union and others are moving aggressively to set the stage for an as-yet unspecified U.N. body to assert control over Internet operations and policies. Most internet overview in conducted in the U.S. Here is what the EU and UN would like:
  • Who should have authority over Internet traffic and domain-name management,
  • How to close the global "digital divide"; and how to "harness the potential of information" for the world's impoverished.
  • How much protection free speech and expression should receive online.

Two countries wanting strict regulation over the Internet are China and Iran with virtual censorship over the world wide web. The "World Summit on the Information Society" (or WSIS) are specifically discussing regulation on speech, libel laws, sales tax, privacy policy, antitrust statutes, and intellectual property.

WSIS suggestions would allow human rights violators and regimes ruled by tyrant's to have a say over citizens of the U.S., deciding what is allowed for free speech and commerce over the Internet. Countries of the European union and Australia also favor some regulation.

We stand by the process that each country should regulate the citizens of their origin within their borders and the U.S. would continue to not regulate the web.

Megan's Law Turned Upside Down on Left Coast

"Did you know that in California, child molesters and rapists are a protected class? It's true. Not only are California landlords banned from using the state's Megan's Law database to decline renting their properties to sex offenders, they're not even allowed to warn other tenants that these paroled criminals are now their neighbors. If they do the first, they can be fined $25,000 for housing discrimination. But if they don't do the second, they can be sued for failing to protect tenants against a known danger," writes Catherine Seip in today's Wall Street Journal.

The ACLU opposes AB 438, and Assembly members Mervyn Dymally (D., Compton), Jackie Goldberg (D., L.A.) and committee chair Mark Leno (D., San Francisco) all voted NO!

The Washington Post reports, "five weeks after Hurricane Katrina laid waste to New Orleans, some local, state and federal officials have come to believe that exaggerations of mayhem by officials and rumors repeated uncritically in the news media helped slow the response to the disaster and tarnish the image of many of its victims.
Claims of widespread looting, gunfire directed at helicopters and rescuers, homicides, and rapes, including those of 'babies' at the Louisiana Superdome, frequently turned out to be overblown, if not completely untrue, officials now say."

Let's see here. Strict constructionist vs. protecting fundamental rights! Seems to me Kerry is confused and why should that not be surprising? A strict constructionist, in the mold of Scalia and Thomas would, in fact, not legislate from the bench, ala the Massachusetts Supreme Court, but interpret the laws and constitution without bias.
